Terms & Conditions

Togs4SpecialSprogs terms and conditions apply to any transactions via this service. If you visit or shop at Togs4SpecialSprogs you accept these conditions. Please read them carefully.

Payment

We accept payment by Paypal for all transactions on this site. All goods remain the property of Togs4SpecialSprogs until full payment has been received.

Delivery Terms

Orders will be shipped subject to product. Orders taken after 2pm (GMT) on Friday will not be processed until the following Monday.

Unless otherwise and previously agreed in writing (on each occasion) between the Seller and Buyer, acceptance by the Buyer of goods which have been ordered shall occur upon delivery, or attempted delivery, to the Buyer.

If the Buyer fails to take delivery during the specified time, the Seller is entitled to consider the order cancelled and charge a re-stock fee, or if agreed in writing the Seller may redeliver, but is entitled to charge a re-delivery fee.

Any date of delivery given by the Seller to the Buyer shall be an estimate date only and while the Seller will endeavour to comply with such date the Seller shall not be responsible for late delivery.

Without prejudice to the generality of the foregoing the Seller shall not be liable for late delivery or failure to deliver through any cause which is beyond the reasonable control of the Seller.

Where the Seller offers goods for next day delivery this is on the assumption that the goods are normally held in stock. If at any time a next day delivery order is placed by the Buyer, but the goods are not available for whatever reason, the Seller shall notify the Buyer, and rearrange delivery and offer to dispatch on a next day basis at the next available opportunity.

Delivery

Except where specifically stated, prices are exclusive of delivery.

Our deliveries in the UK mainland are contracted to outside carriers who deliver Mondays to Fridays (excluding public holidays) between the hours of 8-30am and 5-30pm.

All deliveries must be signed for and you should keep your receipt. If goods are showing obvious signs of damage in transit upon receipt, please refuse to accept the delivery.

Product Availability

Items shown on this website may not always be in stock. If any of your chosen items is not in stock, you will be advised of our best estimate of availability and delivery date at the time you place your order. Please note that an indication of such dates is an estimate only, may be subject to change without notice, and does not constitute a contractual obligation by Togs4SpecialSprogs to supply goods by a certain date. However, if availability is unduly delayed, we will use our best endeavours to keep you informed.

Product Images and descriptions

Please note that the colour of images shown on this website may be affected by the technology used to access it. Whilst we do our best to faithfully reproduce colours, some variation may occur.

Togs4SpecialSprogs attempt to be as accurate as possible. However, Togs4SpecialSprogs does not warrant that product descriptions or other content of this site is accurate, complete, reliable, current, or error-free. If a product offered by Togs4SpecialSprogs is not as described, your sole remedy is to return it in unused condition.

Returns

Non-custom made goods can be returned within 3 days of delivery, at customers expense, subject to items being clean, damage free and with all original packaging. A restocking charge may be made.

Claims in respect of incorrectly ordered goods by the customer must be made within 14 days of delivery; and backed up by written notice. Once the incorrect goods have been returned to Togs4SpecialSprogs by the customer, a re-handling charge may be applied and any requested arrangements for replacement goods will be completed. In the absence of such claim the goods shall be deemed to have been delivered and accepted by the buyer complete and satisfactorily.

It is the buyers responsibility to arrange and pay for the return postage/ shipping costs which must include insurance for the full value of the goods. Proof of posting/shipping will be required.

Damages/Shortages

Togs4SpecialSprogs must be notified within 24 hours of receipt of any damages and shortages, otherwise no claim can be accepted. Goods should be examined on arrival, if boxes are damaged then the delivery note should be signed as such. Un-examined goods should be signed as un-examined on the delivery note. Damaged goods cannot be credited or replaced if they have been used. Special case rates available on some products. Please contact us for more information.

Extent of liability

Togs4SpecialSprogs shall have no liability to the Customer for any loss or damage of any nature arising from any breach of any express or implied warranty or condition of the Contract or any negligence, breach of statutory or other duty on the part of Togs4SpecialSprogs .

If the Customer establishes that any Goods or Services have not been delivered, have been delivered damaged, are not of the correct quantity or do not comply with their description Togs4SpecialSprogs shall, at its option, replace with similar goods any goods or services which are missing, lost or damaged or do not comply with their description, Togs4SpecialSprogs shall either replace the goods without further charge; or accept the return of the goods and credit the Buyer with the price thereof, or make the Buyer an allowance being the difference between the value of the goods at the time of the complaint by the Buyer and the invoice price.

Accepting orders and security

When you place an order we will treat it as an offer to buy. If we accept your order, we will send you a confirmation e-mail with your order number, at which point we make a legal contract with you. However, we will be entitled to refuse to accept your order if we feel it necessary, in which case we will e-mail you as soon as we can to let you know.

When you receive your e-mail confirmation, you will have an opportunity to check the details and correct any errors. We promptly despatch orders, if you wish to cancel an order or make an amendment please do so upon receipt of your e-mail order confirmation within the hour.

In deciding whether to accept your order we may use the information you have given to us, or we already hold about you, or which we receive from any enquiry we may make with various agencies, to confirm your identity. This assists us to protect you and us from fraudulent transactions.  If we decline your offer on security grounds we may contact you to seek an alternative payment method or to advise you to visit one of our stores.

Transit Damage

All goods are examined in detail by ourselves prior to despatch to ensure that they leave in perfect condition. However, transit damage unfortunately can occur. If your purchase is showing obvious signs of transit damage upon delivery, please refuse to accept delivery and notify us immediately. If damage is only evident upon opening of packaging, then you must inform us within 48 hours of receipt. In either case, we will then arrange re-delivery of replacement goods as soon as possible

Claims / Replacements

Claims in respect of defects or errors in quality, description or quantity must be made within 5 days of delivery;  backed up by hard copy or written notice in the post.  In the absence of such claim the goods shall be deemed to have been delivered and accepted by the buyer complete and satisfactorily.

All content included on this site, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of Togs4SpecialSprogs or its suppliers and protected by copyright laws. The compilation of all content on this site is the exclusive property of Togs4SpecialSprogs and protected by copyright laws.

Togs4SpecialSprogs owns the copyright in all materials on this site, which may be used, downloaded, copied, reproduced, republished, posted, broadcast, transmitted or linked only for your own personal and non-commercial use. You agree not to adapt, alter or create any derivative work from any material on this site, or to restrict or inhibit the use or enjoyment of this site by anyone else. It is not permitted to create any link to or from this web site without our prior written consent.

Risk of loss

All items purchased from Togs4SpecialSprogs are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

Applicable Law

By visiting Togs4SpecialSprogs you agree that the laws of England and Wales, without regard to principles of conflict of laws, will govern these Conditions of Use and any dispute of any sort that might arise between you and Togs4SpecialSprogs.

Any dispute relating in any way to your visit to Togs4SpecialSprogs or to products you purchase through Togs4SpecialSprogs shall be submitted to the Courts on England and Wales.

Sales on this web site are governed by English law and you agree to submit any dispute to the non-exclusive jurisdiction of the English courts.
